Fernando leads as Head of the Labour/Employment and Social Security Practice Group in the Firm’s offices in Monterrey, Tijuana and Silao (Bajío).
He is a highly skilled attorney with over 20 years of experience advising and representing exclusively employers in multiple industries in a broad range of labour/employment and social security related matters throughout the country.
Fernando has represented multiple foreign and domestic corporations in all matters related to their strategic labour planning, especially in the “maquiladora”, automotive, aerospace, IT, mining, pharmaceutical, film and textile-retail industries. He has also collaborated with the Universidad Autónoma de Baja California in the design of the curriculum for the Masters of Labour Law Degree, and has been a visiting faculty member. Fernando has been a member and an advisor of the Labour Committees of INDEX Nacional and INDEX Nuevo León, as well as of the National Board of INDEX. He also collaborates periodically with business and law-related publications/newsletters such as El Financiero, Forbes Mexico and International Law Office, publishing articles on different labour/employment and social security related themes. Fernando also participates regularly as speaker and moderator on business and law-related forums.

Fernando has developed an expertise in labour relations in several industries, particularly on individual and collective benefits, preventive labour strategies and strategies to reduce labour costs (i.e. restructure or elimination of labour benefits, work-stoppages, temporary or permanent closures, downsizing, etc.).
He also has substantial experience handling audits and due-diligence procedures regarding compliance with all labour/employment and social security laws and regulations in Mexico, especially derived from complex M&A transactions and business expansions.

Fernando recently advised and represented one of the world’s largest manufacturers of home appliances in a strike notice proceeding filed by the majority union. Fernando designed and implemented the legal defense and the negotiation strategy which ultimately ended the strike and closed the annual collective bargaining process in favorable terms for the company.
Fernando has designed, coordinated and successfully implemented substantial corporate restructures for companies in the “maquiladora”, automotive, aerospace and IT industries (among others), in connection with the recent reform on outsourcing/insourcing regulation, by means of which such companies have been able to continue operating under similar schemes to those they had prior to the enactment of the aforementioned reform.
Fernando engineered the legal strategy and represented the United States of America (through its Department of Justice) in several labour trials initiated in Mexico by former employees of the U.S. Consulate in Monterrey. The cases were settled in favorable conditions for the United States.
Fernando designed, coordinated and implemented the restructure process of labour benefits for an important retail company in Mexico, which affected over 60 stores within the country.
Fernando engineered the legal strategy and represented an important company in the film industry in a high-profile trial initiated by its former CEO in Mexico. The case was settled in favorable conditions for the company.
Fernando participated in the design of the legal strategy and represented the largest mining company in Mexico, in the trials initiated by the legal beneficiaries of the workers deceased in the accident occurred in the mine “Pasta de Conchos”. The 63 trials were won before the Supreme Court of Justice.
